The U.S. Small Business Administration, Office of Advocacy, states that the average small business lifecycle in the U.S. is less than 12.5 years. Collapse or abandonment often comes because business owners are unable to cope with the business challenges of growth, they have an unclear exit strategy, or they mishandle their taxes.

Rhodes says, "In my 20 years as a management consultant, business owners' problems have consistently revolved around three main issues: growth, exit and taxes."

This observation led Rhodes to create a program to help small-business owners deal with growth, exit and taxes (G.E.T.). The G.E.T. Program uses Employee Stock Ownership Plans (ESOPs) as a corporate financial strategy for S-Corporations. The Employee Stock Ownership Plan for S-Corporations is a government subsidy program that has been in place for nearly seven years.

In 1998, Congress took steps to radically reform ESOPs: they decided to include S-Corporations as a type of company that could be sold to an ESOP. Additionally, they provided that if the business was sold to an ESOP, the company would be exempt from all income tax on its profits. The money the owner used to pay in taxes could now be used to partially or fully fund the sale of the business to the ESOP. Not only does this create a market for smaller companies, it also funds the transaction through tax savings and provides retirement benefits to employees.

Despite the many advantages of installing an ESOP, only about 1,500 of the eligible 5.6 million small businesses nationwide have used it. Why is this? Rhodes offers three reasons: 1) A lack of understanding on the part of financial advisors about ESOPs; 2) Confusion regarding the older C-Corporation version of the ESOP –- which is generally less attractive, and 3) Lack of proactive exit planning on the part of business owners.

Why is the government encouraging ESOPs for small businesses? Rhodes says, "The logic is quite simple: the more businesses stay open, the more employees there are to pay taxes and thus create much needed revenue for the government."

In the next 10 to 15 years, 76 million baby-boomers will be retiring. Exploding numbers of baby-boomer business owners will soon be divesting themselves of their businesses. Business owners who plan to retire in the next decade would be wise to create a competitive advantage in a buyers' market. They can begin by exploring ESOP as a succession or exit strategy to help ensure their business lives on and they receive full value for their company.

Electric Thermal Storage (ETS) Heating System Rescuing Facilities from Runaway Commercial Heating Costs

Government/public institutions replace furnace with electric thermal storage heating system reducing energy costs for comfort heating, by as much as 48%.

Unlike manufacturing and processing plants that can push production into "off" hours, public institutions must be open during peak-demand hours to allow public access. Therefore, public and commercial offices with an electric furnace must bear the brunt of high heating expenses.

Yet, further gains accrue to those public facilities that currently rely on a natural gas furnace for comfort heating purposes.

Ecole Gérard Collin of Cabano, a public elementary school located in Cabano, Quebec, needed to provide heating for its 578 students using the school gymnasium. With average winter temperatures of -7 to –9 C to in Quebec pitted against rising utility costs, the school's director of material resources, Donald Daigle, turned to an ETS unit to contain expenses and replace their electric furnace.

"At Cabano, all the space heating is provided by electricity, and it took approximately 70 kW of electricity to heat the gym," recalls Moreau. "But then we installed a Model 8150 ThermElect ETS unit from Steffes. The gym is now heated only by the ThermElect, so we effectively used it as a load reduction tool to reduced the peak-demand costs for the school."

Steffes Corporation is a leading manufacturer of ETS equipment, with thousands of systems in use at residential sites across North America.

According to Daigle, Cabano School has already reduced overall heating costs for the campus by over $1,000-1200 (Canadian) using the ThermElect unit to heat the 1,000 sf gym.

"The impact of the heat reduction was high; in fact, we were able to reduce the peak demand at the school by 70 kW," says Hydro-Quebec's Moreau. "I know the client is very happy."

Pleased with the reality of impressive utility savings, Cabano school plans to purchase two more ETS units for their heating system
in 2006 to heat classrooms and administration offices totaling 2,000 square feet.

Other public institutions have taken note of successful installations such as this, making ETS an increasingly appealing choice for public and commercial buildings.

How can any mind advocate the continued use of Mercury for our children's teeth or fillings without pre-testing them? Given the horrors of CJD being indestructible would any future society recycle old mercury to make more fillings?

Once we start asking this type of question then we realise that, sometimes, good old 'common sense' must be the order of the day. If we want a good future for ourselves and our children, we are all, singularly and collectively, going to have to put some effort into future risk management before it is too late.

Northern California Bricklayers/Stonemasons on Strike

On July 18, 2005, the Northern California Bricklayers/Stonemasons went on strike. Events leading up to the strike began when contract negotiations broke down last week. The Northern California Masonry Contractors Association sent a letter to the Bricklayers/Stonemasons and Allied Craftworkers (BAC) Local 3 Union announcing they are cutting off contract negotiations.

Oakland, CA (PRWEB) July 25, 2021 -- On July 18, 2021 the Northern California Bricklayers/Stonemasons went on strike. Events leading up to the strike began when contract negotiations broke down last week. The Northern California Masonry Contractors Association sent a letter to the Bricklayers/Stonemasons and Allied Craftworkers (BAC) Local 3 Union announcing they are cutting off contract negotiations.

BAC decided to call a strike against members of the contractors' association in an effort to get them to return to negotiations. The major points of contention focus around health care, retiree subsidy, pension funding, and travel compensation. Since June 2002, wages have only increased $0.80 (80 cents) per hour; that’s an average increase of $0.26 (26 cents) per year!

BAC Local 3 Bricklayers/Stonemasons of Northern California have been working without a contract since July 1, 2005. In July 2004, the Bricklayers/Stonemasons took a $1.50 per hour pay cut to fund their health care benefit. Bricklayers/Stonemasons are asking for a raise to recover the July 2004 pay cut and to cover increases in health care that are scheduled for January 2006. Currently, the Bricklayers/Stonemasons pay $7.25 per hour for health care. That is more than people earn for minimum wage. Further, the contractors blocked the funding of the Bricklayers/Stonemasons retiree’s health care subsidy.

The Bricklayers/Stonemasons are also seeking an increase to cover the cost of living increases, such as gas and housing. Since last year, gasoline in California has increased over 40% while the Bricklayers/Stonemasons wage decreased by an average of 3%. A bricklayer’s job is never in the same place month after month as it might be for someone who works in an office in one location. Due to the few qualified bricklayers/stonemasons in California, the large geographic area of the Northern 46 counties, and variable job locations, an employer may require a bricklayers/stonemason to travel over 200 miles a day. This is common in such specialty crafts as masonry.

The average bricklayer earns less than $37,000 per year due to the seasonality of the occupation. According to the California Budget Project report “How much does it cost to raise a Family in California” (2003), a bricklayer’s family is not making ends meet. Many Bricklayers/Stonemasons and their families are having difficulty making rent or mortgage payments coupled with the cost of childcare, food, gasoline, and automotive expenses.

Economic, labor, and work projections all indicate robust growth for the construction and bricklayer industry. The Bricklayers/Stonemasons are reasonable and willing to discuss all options with the contractors. The bricklayer’s membership overwhelmingly voted to reject the contractor’s latest offer and believe they can solve the differences through further negotiation. The Bricklayers/Stonemasons came to bargain in good faith and as of today, the contractors association has not made a logical argument for their refusal to grant the Bricklayers/Stonemasons the requested increase in compensation.

Bricklayers/Stonemasons and Allied Craftworkers represent approximately 3,000 Bricklayers/Stonemasons, Tile Layers and Finishers, Pointer Cleaner Caulkers, Marble Setters and Finishers, Terrazzo Mechanics and Finishers, and Refractory Bricklayers/Stonemasons who work various aspects of the industry in the Northern 46 counties of California.

PMR Report: Impressive Growth in the CEE Construction Sector

According to a report just released by PMR, in 2005-2006 the construction market of Central and Eastern Europe (CEE) will expand at an impressive annual pace of 8-10%. Robust sector performance will be posted by all countries in the region, though Russia stands before the best development prospects.

(PRWEB) July 25, 2021 -- The Polish consulting and research company PMR has published a new report, “The construction sector comparative analysis 2005-2006: the Czech Republic, Hungary, Poland and Russia”. The study analyses the condition of the construction market in the region of Central and Eastern Europe (CEE).

In the report CEE is defined as Russia, Poland, Hungary and the Czech Republic.

According to the PMR report, the CEE construction market will expand by more than €32bn in the next two years to total €109bn at the end of 2006. Naturally, Russia as the region’s largest construction market with an estimated value of ca. €41bn, is nearly 14% bigger than all the remaining CEE markets put together. According to PMR’s projections, its size advantage will shrink slightly in the next two years to 12% as at the end of 2006. Poland is home to the second largest CEE construction market. Remarkably, despite the fact that the Czech Republic and Hungary have similar populations, the former has a more than 70% larger construction market than the latter (based on 2004 data). PMR forecasts that in the next two years the Czech advantage will deepen further. As at the end of 2006, Russia will continue to be the largest construction market in the CEE with Poland remaining in second place.

In 2005 2006, the individual construction markets will develop at an average annual rate of 8 11%. In the opinion of PMR analysts, such sizeable and stable growth means that the sector is at the start of an uptrend. The sector will experience growth not posted in years, particularly in Poland, where construction output has seen a downtrend in recent years (in 2001 2004 average annual changes in construction output sold ranged from -8% to 2%). Yet, PMR analysts point out that, in contrast to construction industry development in recent past, there will not be any significant variations in the rates at which the individual construction markets will expand in the near future.
The upcoming years will bring most decisive growth to the Russian construction market: average annual growth of close to 11%. At the same time Poland, the Czech Republic and Hungary will see their markets expand at around 9-10% per annum.

According to PMR, in the next few years the following factors will be most material to the dynamic development of the construction markets in the individual countries of the CEE region:
• Civil engineering construction development, particularly dynamic in new EU member countries, the Czech Republic, Poland and Hungary. Fuelled by an influx of EU funds, the bulk streamlined to the engineering construction sector to finance the construction and modernisation of the national road and rail infrastructures. Underdeveloped road network and a lack of modern connections and below-standard road quality creates an opportunity for civil engineering to become the powerhouse of the entire construction industry in the near future, not only in Russia but in the entire CEE region.
• Residential construction development, which when compared with the EU states is below standard in the Czech Republic, Poland, Russia and Hungary both in terms of quantity and quality of available housing. This opens a window of opportunity, particularly for construction companies specialising in renovation work. Furthermore, the CEE countries trail much behind the EU-15 in home completion statistics. This is also an area for sizeable prospects for construction companies, especially within the context of the noticeable housing deficit prevailing over the entire CEE region.
• Non-residential construction market will also contribute towards growth in the construction sector, though less than the above segments. “Though the CEE countries are no longer offering as attractive rates of return on capital invested in non-residential construction than even a couple of years ago, the sector will continue to expand with dynamism, especially in Russia. Nevertheless, its percentage share in the value of the total construction market is in for a marked drop,” Marzena Opalinska, PMR analyst, concluded.

Though the above trends hold true for all countries in the region, there are obvious differences among the individual construction markets. What makes each unique is the subject of analysis in individual construction market reports on the Czech Republic, Poland, Russia and Hungary, which PMR has also recently released.
According to PMR, the key features of the CEE construction markets are:
• The Russian construction market is in many ways underdeveloped in comparison to its counterparts not just in the EU but also in the CEE region. The country has serious deficits in housing, modern non-residential construction as well as civil engineering construction. Concurrently, the percentage share of the construction industry in the Russian GDP stands highest in the CEE region. The country’s prospects for future development in construction industry are best from among all analysed countries.
• The Polish construction industry has been amidst a crisis in recent years. Yet there have been signs of a gradual improvement since 2003. More is being invested in the sector and more construction permits are being issued for residential buildings. This translates into higher sales for construction companies. Poland has sizeable deficits both in housing and – especially – in infrastructure. The latter segment stands to benefit the most from the greater inflow of EU funds and, thus, will continue to be the main engine behind the expansion of the Polish construction market.
• The Czech Republic has the most developed construction market in the CEE region. The per capita value of sold construction is highest among the CEE neighbors as is worker productivity in the sector. The Czech Republic is also at the statistical forefront in motorway quality, quantity of modern office space per capital-city resident, as well as in availability of basic utilities at homes. Nevertheless, the Czech construction market is still a field of great opportunity for construction companies, inter alia in residential construction sector.
• The Hungarian construction market leads the region in terms of new housing. It may boast of more per capita home completions than any other country in the region. It has the most developed housing loan and mortgage system and the best construction permit statistics in the region. At the same time, in the last couple of years the situation in the sector has been very unstable, with sizeable fluctuations in data on sold construction output. Yet, this market holds great potential since the percentage share of the construction sector in the GDP is the lowest in the CEE region, significantly below the EU averages.

To summarize, the PMR report speaks of impressive prospects for future development of the CEE construction market. According to its authors, the current condition of the residential, non-residential and engineering construction sectors in the analyzed countries is in many ways below that of the developed construction markets of the EU 15. For this reason, future of the CEE construction market looks very good, better than for the EU.

The first task was to pump the tanks out to remove any liquids and sludge. Tanker trucks were used to remove the liquids. A vacuum truck was then utilized to remove any remaining sludge.

Following removal of the liquids and sludge, the underground storage tanks were exhumed using a Komatsu PC-400-LC6. The tanks were placed on polyethylene and then cut into pieces using a Komatsu PC300-5 with a shear attachment. The steel tank pieces were sent offsite for recycling. The excavation area was then backfilled with clean fill materials.

Masonry Contractors in Contract Dispute with California Bricklayers

Bricklayers and Allied Craftworkers call for a strike against members of the contractors association.

Oakland, CA (PRWEB) July 22, 2021 -- On July 14, 2005, the Northern California Masonry Contractors Association sent a letter to the Bricklayers and Allied Craftworkers (BAC) Local 3 Union announcing they are cutting off contract negotiations and would lock out all member employees of BAC Local 3 if BAC engaged in a strike against any contractor association member.

Since the contractors were not willing to continue to negotiate, BAC decided to call a strike against members of the contractors association on July 14, 2005, in an effort to get them to return to negotiations.

BAC Local 3 Bricklayers of Northern California have been working without a contract since July 1, 2005. Contract negotiations began May 25, 2021 with the Masonry Contractors Association and the process has faced a few delays. Some of the delays included documents that contained omissions without notation and a misquote of the Industrial Wage Order 16-2001.

Due to an incident on June 9, 2021 the negotiations were further delayed. The incident was severe enough to cause the Alameda County Superior Court to issue an injunction. The Ralph Civil Rights Act, Civil Code section 51.7 "provides that all persons within this state have the right to be free from violence committed against themselves or their property because of their … position in a labor dispute."

A presentation by BAC Local 3 was eventually made on June 15, 2005, which included forecasts on economics and employment for the brick and construction industry of California. The projections indicate there will be approximately $60 billion in construction and 1,000 new bricklayers needed. Data sources included: the California Five Year Infrastructure Plan, published by the California Department of Finance; Project Labor Agreement data compiled from Construction and Building Trade Councils; various articles and publications that substantiate a surge in construction growth, such as a study from the University of the Pacific and various realty advisor groups; California E.D.D.; Labor Market Information Division; BLS; Construction Labor Research Council; Consumer Price Index (CPI) information; and a report from the California Budget Project on the cost of living in California.

The third party administrator of the BAC Health and Welfare trust fund reported the average monthly retiree benefit received by the bricklayers retiree is almost equal to the monthly contribution they have to pay for health insurance.

BAC Local 3 also presented the advantages of being a BAC Local 3 contractor. BAC Local 3 established a website (www.bac3-ca.org) with a section that promotes the contractors; purchased radio advertising to promote the trade, increase recruiting, and increase brand awareness; used direct mail to promote the contractors to general contractors, developers, architects and engineering firms; distributed publications that emphasize safer building practices using masonry; enhanced recruitment efforts through the Helmets to Hardhats program; participated in a television sponsorship on the history of bricks through the History Channel.

In July 2004 the bricklayers took a $1.50 per hour pay cut to fund their health and welfare benefit. BAC is asking for a raise to recover that pay cut and to cover future increases in health and welfare. Additionally, BAC is seeking an increase to cover the cost of living increase, such as gas and housing and a subsidy for the retiree's health and welfare.

As of today, the contractors association has not made a logical argument for their refusal to grant the bricklayers the requested increase in compensation.

Bricklayers and Allied Craftworkers represent approximately 3,000 Bricklayers/Stonemasons, Tile Layers and Finishers, Pointer Cleaner Caulkers, Marble Setters and Finishers, Terrazzo Mechanics and Finishers, and Refractory Bricklayers who work various aspects of the industry in the Northern 46 counties of California.

The Eighth Annual Congressional Renewable Energy and Energy Efficiency EXPO, held in the Cannon House Office Building in late June, attracted several dozen key figures in national energy policy.

(WASHINGTON) – Members of Congress, executive branch officials, congressional staff and journalists recently had the opportunity to see for themselves the energy-saving benefits of "cool roof" technology. The Eighth Annual Congressional Renewable Energy and Energy Efficiency EXPO, held in the Cannon House Office Building in late June, attracted several dozen key figures in national energy policy.

Among the presenters was Custom-Bilt Metals, a longtime leader in the painted metal industry, which was one of the first to utilize and test new, highly reflective energy-saving metal roofing systems. The audience included several members of Congress as well as David K Garman, under secretary of the U.S. Department of Energy. The event was co-sponsored by members of the Senate and House Renewable Energy & Energy Efficiency Caucuses.

"We encountered a great deal of interest in the energy-saving potential of cool roof technologies," said Tony Chiovare, president of Custom-Bilt Metals. Custom-Bilt Metals participated in the event at the invitation of Lawrence Berkeley National Laboratory, which has developed a test site that is currently monitoring the energy savings in homes that were built using Custom-Bilt Metals’ ULTRA-Cool™ coating, a new high reflective finish developed by BASF Corporation’s Industrial Coatings Division. Another key participant was Bob Scichili, a consultant to Custom-Bilt Metals who was instrumental in developing the finish when he was employed by BASF.

"The Congressional Energy EXPO was an unqualified success from our perspective," said Chiovare. "We had an opportunity to talk about cool roof technologies to several dozen interested parties from government, who are in a position to make such systems even more attractive through tax benefits or other incentives."

Chiovare noted the energy bill that is currently pending in Congress provides a tax credit for homeowners who take energy conservation steps such as installing cool roof systems.

"The people we met at the Congressional Energy EXPO were very interested in learning what they could do to encourage the use of this energy saving technology," Chiovare said. "The questions they asked us were focused on what cool roof systems can accomplish, and what government can do to encourage their use."

Cool roofs such as Custom-Bilt’s ULTRA-Cool system work by reflecting a greater amount of the sun’s infrared energy, Chiovare explained. According to test results at the Lawrence Berkeley Laboratory demonstration site, a metal roof with a cool roof finish can be as much as 55 degrees cooler on a sunny day. This could produce a nearly 20 percent saving in air-conditioning costs. In addition, cool roof technology can also help reduce the "urban heat island" effect, which causes increased demands on power plants.

"Widespread use of cool roof systems could have a tremendous positive impact in reducing energy consumption, not just for individual homeowners but for entire communities," Chiovare said. "We believe strongly in the importance of energy-saving cool roof technology, and we are committed to helping develop this technology to its full potential."

Southern California’s Economy Will Grow through 2006, With Support From Aerospace, Business & Professional Services, Technology and Tourism

“Motion picture/TV production and International Trade are also expected to grow, but both industries face major problems,” said Chief Economist Jack Kyser, LAEDC in his Forecast to be delivered today in Downtown Los Angeles.

Los Angeles, CA (PRWEB) July 18, 2021 -- Southern California’s economy will grow at a healthy pace in 2005-2006, according to the Los Angeles County Economic Development Corporation’s (LAEDC) “Mid-2005 Economic Forecast & Industry Outlook Update,” presented this morning (Tuesday, July 19, 2021) at a business breakfast at the Biltmore Hotel in downtown Los Angeles. Though not as strong as the boom years of the late 1990’s, the area’s economy still will turn in the best performance since 2000. A new feature of this year’s Mid-Year Forecast is an assessment of the performance of different areas within Los Angeles and Orange counties.

Among the risks on the 2006 horizon is the housing situation – will it be the “bubble” scenario or the “price ceiling” scenario? The LAEDC Forecast also asks questions about the business environment in the state. “Will there be a modest improvement or more slippage?” said Chief Economist and Vice President Jack Kyser, LAEDC. “To meet the growing demand from their customers, companies are willing to invest in plant and equipment but are still being cautious about hiring.” The Forecast also warns that some military bases in California are still on the Base Realignment and Closure (BRAC) chopping block; in fact San Diego County may lose two more military facilities when it’s over.

Nonfarm employment in California is estimated to grow by 1.8 percent, or 265,000 jobs, in 2005, and
by a forecast 1.7 percent, or 253,000 jobs, in 2006, compared to the one percent increase in 2004. In Southern California, the leader in job growth will continue to be the Riverside-San Bernardino area, where nonfarm job growth will run at 3.0 percent in both 2005 and 2006, or increases of 34,400 and 35,900 jobs respectively. Orange County should see a 1.9 percent, or 27,600 job, increase in 2005, and a 1.8 percent, or 27,400 job, gain in 2006.

Los Angeles County will continue to have muted nonfarm job growth, with a 1.0 percent, or 41,600 job, gain in 2005 and a 1.1 percent, or 44,500 job, increase in 2006. “There has been much hand wringing about LA County’s weak nonfarm employment performance, essentially 15 years of no job growth,” explained Kyser. “However, the civilian employment series (which includes the self-employed and unpaid family workers) indicates the County is at a new employment high. Clearly more people are working as independent contractors and in other ways that do not get captured in the nonfarm employment survey, and Los Angeles County is on the leading edge of this trend.”

The LAEDC Forecast ranks the performance of the region’s major industries, four of which received “A” ratings at mid-year 2005. These include classic aerospace, business & professional management services, technology and tourism. Two other industries got “B+” ratings – financial services and bio-medicine. The lowest industry ratings went to health services/hospitals with a “D”. The Forecast noted that while hospitals face intense financial pressures, there is a building boom in new facilities. The apparel design and manufacturing industry got a “C-“ with LAEDC’s observation that the industry is in a major transition that is not well understood by most people.

Ratings for two of Southern California’s signature industries were downgraded. Motion picture/TV production was moved from a “B” to “B-“. “While there will be job growth, this industry is coping with piracy, weak attendance/viewership, and a more intense threat of run-away production costs,” said Kyser.

International trade was moved from a “B+” rating to “B.” “Everybody will be holding their breath to see if congestion rears its ugly head at the local ports over the next few months,” said Kyser. “Another serious backup would have very negative business connotations for the region.”

A new feature of the LAEDC Mid-Year Forecas” is regional performance rankings for Los Angeles and Orange counties. The main indicator is employment, which was obtained from the California Employment Development Department’s ES 202 data files. These numbers understate the employment situation as they do not include independent contractors, which are a significant factor in Los Angeles County. The best performance in Los Angeles County’s regions, what the LAEDC called “overachievers,” came in the East San Fernando Valley, the San Gabriel Valley and West Los Angeles. Five regions turned in an “above average” performance, while three were noted as being “in transition.” “Two regions in Los Angeles County need more support – North Gateway (southeast area) and the South Los Angeles area,” said Kyser. “They need more thoughtful approaches to economic development and true involvement by business and government leaders.”

In Orange County, both the north and south regions have performed well job-wise, but the advantage went to the south. The LAEDC Forecast also contained 2004 gross domestic product (GDP) rankings. California placed eighth among the nations of the world, behind Italy and China (excluding Hong Kong) but ahead of Canada and Spain. The Los Angeles five-county area placed tenth, behind Spain and ahead of South Korea and Mexico. Los Angeles County ranked 17th in gross product, ahead of Switzerland and Belgium.

The LAEDC Forecast also spotlighted some longer standing concerns for the Southland including: congestion in moving both people and goods, K-12 education, and housing – both overall supply and affordability.

“The final concern is – who’s in charge,” said CEO and President Lee K. Harrington, LAEDC. “There is little confidence in the capability of politicians alone to devise solutions to Southern California’s many challenges. Business will have to become more involved, and that’s why we are forming the Southern California Leadership Council. The response so far has been strong and we believe that we can find solutions that will foster economic growth while improving the region’s quality of life.”

Bob Moore Construction Company Delivers 12-Screen Theater to Mansfield, Texas

Commercial Contractor Bob Moore Construction Company has completed a 12-screen Cinemark movie theater in Mansfield, Texas, which opened to the public on June 29. The new Cinemark 12 is the company’s 18th theater in the Dallas / Fort Worth area. It is the first theater ever in Mansfield. Bob Moore Construction was the general contractor for this project, which was completed two weeks ahead of schedule.

ARLINGTON, TX (PRWEB) July 18, 2021 -- Commercial Contractor Bob Moore Construction Company has completed a stunning 12-screen Cinemark movie theater in Mansfield, Texas, which opened to the public on June 29.

The new Cinemark 12 is the company’s 18th theater in the Dallas / Fort Worth area. It is the first theater ever in Mansfield and is expected to be a centerpiece of this dynamic community’s expansion. The theater is located in Mansfield Town Center West, a 39 acre retail and office complex owned and operated by Kossman Development Company in Pittsburgh, Pennsylvania. Bob Moore Construction was the general contractor and Beck Architecture in Dallas was the architect for this project.

The new 42,265 square-foot theater features a large concession area and seating for 2,010 patrons. The exterior features a dramatic full-height stone veneer, the first time this finish has ever been used on a Cinemark theater. All 12 screens employ top quality Christie projectors, wall-to-wall screens and Dolby digital sound; the Cinemark 12 provides “the best seat in town” with the most modern version of stadium seating on the market, including high-backed rocking seats.

“It turned out great,” said Chris Cline, Project Manager for Cinemark USA. “We’re very happy with the work Bob Moore Construction did. The superintendents and everyone involved were very professional and the quality of workmanship is just outstanding.”

“We worked with Cinemark and our subcontractors from day one to build a sense of pride,” said Curt Hellen, Senior Project Manager for Bob Moore Construction Company. “I think it’s telling that when the workers who built this theater were invited to bring their families for a sneak preview before the grand opening, over 1,200 people participated. I saw a lot of pride and excitement in the community, in Kossman and Cinemark and in our subs. That resulted in a superb project we were able to deliver ahead of schedule.”

While the schedule originally called for the theater to open July 10 Bob Moore Construction completed the project almost two weeks early, in time for the release of the summer blockbuster War of the Worlds and a special grand opening celebration on June 28.

“It was a big deal for us that Bob Moore Construction could get the theater done ahead of schedule, in time for the movie’s release,” Cline said. “We originally planned to open July 10 but the City of Mansfield wanted us to open by July 4. Then with the release of War of the Worlds, we wanted to move it up to June 29. It meant a lot to us and to the city and everyone else that we could do that.”

Use different levels of the capital structure to prevent project ownership dilution: By using mezzanine financing to fill as much of the equity gap as possible you will lower your overall cost of capital while not being forced to give up as much ownership in the project as you would by closing the entire equity gap with a joint venture equity partner.
3. Negotiating the proper type of equity joint venture can be critical to the financial success of a project: If you move up the leverage curve with the proper combination of senior and subordinate debt the amount of equity needed from outside investors is minimized. Using the right pari-passu, or preferred equity investment structure can leverage the sponsor co-invest to as little as 2% -5% of the project equity requirement while still leaving the sponsor with the majority of project ownership.
4. Individual Investors vs. Institutional Investors: Decide early where you choose to seek your capital partners and investors and be willing to live with your decision. With rare exception if a sponsor can meet institutional suitability tests they will be better served by accessing commercial capital markets rather than dealing with individual investors. Institutional investors have more knowledge and flexibility when structuring transactions giving owners more operating flexibility.
Institutional investors have deep pockets and can provide the appropriate level of financing to allow sponsors to engage on multiple projects at one time thereby creating the ability to grow their business with greater velocity when contrasted to the leverage provided by individual investors. Additionally most institutional investors prefer passive investments and will only exercise dilution or control provisions in the rarest of circumstances. Lastly, institutional investors often times can provide tremendous non-financial value adds in the form of knowledge base, intellectual capital, market contacts and the like.
5. Resist the temptation to do “one-off” project level financings: Disparate financings at the project level can at a minimum restrict a borrowers future ability to cost effectively monetize on value creation by subjecting the property to pre-payment issues in the case of refinancing or disposition prior to the expiration of lock-out periods. Worse than trapping equity at the project level may be the fact that one-off financings restrict the ability to pool the asset with the balance of the portfolio creating a lack of optimized leverage and timely access to credit which in turn can create capital constraints by slowing acquisitions activities or operating initiatives.
Lastly, large portfolios or even smaller sub-portfolios created by a multitude of one-off financings can create a management nightmare. This is due to constantly maturing debt rollover which will subject individual assets to credit, interest rate and market risk. This type of risk is not present when financing at the portfolio level due to the ability to trade in and out of collateralized pools where pricing, sizing and structural aspects are known constants.

Understanding how to access and maneuver within the commercial capital markets and effectively leveraging the many benefits of structured finance techniques can be the defining difference in optimizing the scalability and efficiency of your commercial real estate venture.

Minaean (TSXV: MIB) Announces Extension of Project in Northern India

Dust Explosions Are Preventable

Chairman of the U.S. Chemical Safety and Hazard Investigation Board (CSB) declares chemical dust explosions in the U.S. a "serious industrial safety problem," yet "are preventable."

(PRWEB) July 12, 2021 -- According to information released by the U.S. Chemical Safety and Hazard Investigation Board (CSB) through dust explosions reveals that nearly 200 dust fires and explosions have occurred in U.S. industrial facilities over the past 25 years, resulting in approximately 100 fatalities and 600 injuries.


The CSB is an independent federal agency charged with investigating industrial chemical accidents. They are currently investigating the causes and prevention of dust explosions, such as those at West Pharmaceutical Services (North Carolina), Hayes Lemmerz (Indiana) and CTA Acoustics (Kentucky). The CSB claims that a total of 14 people were killed and 81 injured in these three accidents alone.

According to CSB Chairman Carolyn Merritt “dust explosions are preventable,” adding later that there is no comprehensive federal program that addresses this problem.

“There are a whole host of dust explosion protection solutions that currently exist, which could prevent, or minimize, the effects of an explosive event,” says David Cvetas, President of Cv Technology (www.cvtechnology.com) a prominent dust and gas explosion protection consulting and technology company. “Corporate executives that want to minimize the substantial risks need to take this issue seriously and not wait until an explosion occurs to take action.”

According to Cvetas, many corporations are slow to accept the reality that a dust explosion could happen to them, despite the massive financial risks and potential loss of life.

“The corporations we work with operate industrial or material processes that produce revenue from a quarter million to several million dollars a day,” observes Cvetas. “A single incident can shut a facility down for weeks or months, with devastating effects.”

Almost all organic material or un-oxidized metal, when in a dust cloud, will ignite at a temperature below 500 C approximately the temperature of a recently extinguished match. Companies in pulp and paper, plastics, chemicals, pharmaceuticals, textiles, and milling operations that handle powders and bulk solids are also susceptible. Food dusts such as sugar, starch, flour, and cocoa are also major causes of explosions.

Dust Explosion Prevention
Today, safety-conscious facility managers are turning to specialized consultants and technology vendors to develop strategies to reduce or eliminate the underlying causes of explosive events.

Cvetas emphasizes that the best dust explosion protection systems blend active and passive technologies, and are as non-intrusive to process operations as possible. Many people are looking for concrete contractors in their community, but very few small contractors have websites. However, a website doesn't have to cost a lot of money, and in many cities you might have no competition online. Read these tips on how to make your site stand out.

2. Make sure that you include the name of your city and the kind of services you provide in all your headlines, title tags, and description tags. This will help the search engines find you when local customers search for your services. In some cities you may be the only contractor with a website – so make sure the search engines can find you.
3. Don’t include an email address if you don't intend to answer your emails promptly - it can really make a bad impression to people who use the Internet. It’s definitely a good idea to use email if you can, but if you prefer that people contact you by phone, list your phone number prominently, along with the hours when you can be reached.
4. Use graphics sparingly, because lots of pictures make the pages load slowly. When you do use graphics, choose them wisely - a picture of your office staff will be less useful than a good photo of your latest project.
5. You don’t have to be a great writer, but the copy on your page should highlight the services you provide. People will be more comfortable in making the call to your office if they know you build foundations, or concrete slabs, or curbing -or whatever service they happen to need. Be specific, and show examples of your work if you can. And be sure to check your spelling.
6. Make sure you have at least one other website linking to you after you get your site online. If you don't have anyone linking to you, the search engines won't find you. Submitting your web address to the search engines won't help if you don't have links to your site. Many inexpensive web hosts now offer templates and simple programs for creating a website. These hosting services can cost less than $10.00 a month – which may be the least expensive form of advertising you can find. The Problem with Cartridges
Virtually every cartridge is opened the same way. You cut off the end of the plastic nozzle and poke something down the nozzle to pierce the foil seal. Does that sound easy? Well imagine that you are on a roof trying to fix a shingle with roofing adhesive. You realize you have nothing to poke down the nozzle to break the seal. Ask any experienced builder--it happens all the time.
So you try a nail you have in your pocket but it isn’t long enough or thin enough.
You try a twig from an overhanging tree but that isn’t smooth or straight enough.

Historic Texas Courthouse to be Honored by Mural on Hotel Wall

Touring historic Texas courthouses is an excellent way to learn about old world architecture and the celebrated pasts of the counties they reside in, so to pay tribute to the Somervell County Courthouse, one local hotel is having a mural painted memorializing the courthouse.

Currently there are more than 200 courthouses built before 1940 that are still standing today. In 1881, Texas legislature passed a bill authorizing counties to sell bonds to finance the construction of new courthouses. In the years between 1880 and 1900 many Texas courthouses were constructed. This time frame is commonly referred to as the “Golden Era” of courthouse building. The courthouses were typically built in the center of the town square to reflect its central role in the life of the county.

Texas courthouses display some of the finest examples of 19th century and early 20th century architecture. French Second Empire and Romanesque Revival architectural styles were very prevalent during the Golden Era. The following is an example of the typical steps involved in the D/B project procurement process.

The following is an example of the typical steps involved in the D/B project procurement process:

Step 1 Strategic Facility Planning - The Owner analyzes its current and future facility requirements to determine the appropriate facility development plan for the planned use.

Step 2 Program Definition - The Owner establishes the project requirements in terms of facility size and performance, criteria, finish requirements, quality standards, applicable codes, regulatory standards, population/capacities, equipment requirements, etc. These requirements are defined and articulated either by in-house professional staff or by an outside consultant.

Step 3 Request for Qualifications (RFQ) - Professional, financial and experiential requirements for Proposors and the general project parameters are articulated in an RFQ, either by in-house staff or by an outside consultant.

Step 4 Qualifications Statement - The Owner advertises the project and receives and reviews qualification statements in response to the RFQ. Generally the three, and no more than five, most qualified firms are short-listed.

Step 5 Request for Proposals (RFP) - The Owner solicits design and cost proposals from the short-listed design-build teams in a RFP. Among the items found in a typical RFP are project design criteria, site information, contract requirements, selection procedure and proposal (submittal) requirements.

Step 6 Pre-Proposal Conference - Some owners hold this optional meeting early in the proposal preparation period to allow Proposors to ask questions and request clarifications.

Step 7 Proposal Submission and Evaluation - Once received, the Owner evaluates proposals on the basis of quality of design, price and other predetermined factors (best value). The Owner may request that the Proposors make in-person presentations to the Owner's selection panel.

Step 8 Contract Award - The selected Proposor enters into contract(s) with the Owner, which incorporates both the Owner's requirements and the Design-Builder's proposal.

Step 9 Documents/Construction - Upon completion of the design documents for all elements (or for specific phases) of the project, construction commences. The contract may provide for fast-track methods, allowing construction to proceed after logical phases of design and permitting are completed, but prior to completion of the entire body of construction documents.

Step 7 above, Proposal Submission and Evaluation, is the best chance the Owner will get to ensure that it gets the project it wants and the best value for its money. Best value considers both qualitative factors (i.e., design solution, management and schedule) and price. In the submission/evaluation process, qualitative factors and price are considered on a formula basis.

The Owner should appoint a selection panel to perform the qualitative rankings. Generally, this is the same committee and/or panel that the Owner used to determine the most qualified Proposors. There are several methods the panel can use to evaluate the proposals; six of these are discussed below. Each has been successfully used and each has its merits, though no single process is appropriate for all situations.

1. Weighted Criteria - The RFP requires submission of a qualitative proposal and firm price. The Owner establishes a point rating for qualitative factors and for price. (For example, qualitative factors may weigh 60 points, and price 40 points.) The Owner receives the qualitative proposals and the price proposal simultaneously. The price proposal is contained in a separate envelope. The Owner may then hear oral presentations from each Proposor. The Owner assigns points on a scoring matrix for each Proposor's response for each of the evaluation factors. After the Owner evaluates the qualitative criteria, it reviews the price proposal envelopes. Maximum price points are assigned to the lowest dollar bid, and all others are scaled inversely proportional to that amount. High total points then determine the award.

2. Adjusted Low Bid - A variant of the weighted criteria process is the adjusted low bid. The process follows the same steps through receipt of qualitative proposals. Following the oral presentations, qualitative aspects are scored and totaled on a scale of 0 to 100 scale expressed as a decimal (e.g., a score of 85 is written 0.85). After calculating the scores, the Owner opens each bidder's price envelope. Price is then divided by score (expressed as a decimal) to yield an "adjusted bid".

3. Equivalent Design/Low-Bid - This evaluation procedure parallels the two previous processes up to receipt of qualitative proposals. The Owner critiques the technical proposals, and gives each Proposor a deadline to respond with specified design changes and corresponding price amendment (either add or deduct) in order to make all proposals technically equivalent (referred to as "technical leveling"). Revised designs are evaluated by the Owner, which then opens the price envelopes, both base and amendments. Award can be made with heavy or sole emphasis on price because the proposal critique should have resulted in equivalent designs.

4. Fixed Price/Best Design - Contract price is established by the Owner and is stated in the RFP. The Proposers then submit only qualitative or technical proposals, as all price offers are identical. Following oral presentations (optional), the Owner uses its evaluation criteria to score the proposals. Award goes to the firm offering the highest scoring proposal for the stipulated price.

5. Meets Criteria/Low Bid - This method of evaluation most closely resembles the traditional bid process. Typically, the RFP provides specific requirements, but fall short of final construction documents. The Owner solicits proposals from qualified firms, and evaluates those proposals to ensure that they meet the base criteria. The Owner then awards the contract to the low bidder. The selected firm's role is to complete construction documents in a reasonable manner rather than to develop a unique design for the project. The weakness of this process is that it eliminates two of the most advantageous features of design-build: multiple design solutions and the creativity/ innovation of competing design-build teams. It is best suited for procurement of utilitarian facilities (e.g.: storage sheds, pre-engineered buildings, etc.).

6. Emergency Award - As the name implies, when public safety or welfare is threatened, a public Owner may authorize negotiations with the best-qualified design-build firm available at the time, using references and/or previous Owner experience with the firm as justification for the selection. As stated at the beginning of this section, the above-described steps are generic and optional - an Owner can decide to use or not use any or all of them. But they do provide an overview of a process that project Owners have successfully used in the past.

CTL|Thompson Chosen to Work on Canon City Schools

CTL|Thompson (CTL|T) has been selected to provide geotechnical engineering and materials testing services for the Cañon City high school addition and the new kindergarten through eighth grade school for Fremont County School District R.E. 1.

Cañon City, Colo. (PRWEB) July 10, 2021 -- CTL|Thompson (CTL|T) has been selected to provide geotechnical engineering and materials testing services for the Cañon City high school addition and the new kindergarten through eighth grade school for Fremont County School District R.E. 1.

The new 125,000 square foot kindergarten through eighth grade school broke ground in February 2005 with total construction valued at $16 million. The design team includes architect Christiansen Reese and Partners and general contractor Nunn Construction.

With an estimated construction value of $8.7 million, Cañon City high school broke ground in June 2005 adding 46,000-square-feet of classroom space. The design team for this project includes architect Christiansen Reese and Partners and general contractor HE Whitlock.

CTL|T performed soils and foundation investigations for both sites and is currently providing compaction testing, concrete testing, observation of drilled pier and auger-cast pile foundations, masonry testing, and other services needed by the design and construction team for the schools.

The major problem addressed at the new kindergarten through eighth grade school was highly expansive claystone bedrock. CTL|T's recommended foundation solution to the expansive soils was drilled piers bottomed in bedrock. This was an economical solution and should control risk of future damage due to heave.

At Cañon City High School, there are isolated areas of expansive soils. CTL|T recommended moisture injection in the areas with expansive soils. Due to the subsurface conditions and the proximity of the existing high school building, the new structure is supported on an auger-cast pile foundation system.

What the heck are all these new yellow bumps on every street corner?

New sidewalk ramp tactile cues provide renewed additions to pedestrian safety.

(PRWEB) JULY 7 2005 -- It seems like every time we turn around there’s a new curb ramp with all kinds of yellow, red or white bumps on them. Do they do something? Is this part of that chirping noise we hear at intersections? They weren’t there yesterday, now they’re everywhere…what ARE they?

A frequently asked question among the general public, and one that provides ample room for any number of responses. Jon Julnes of Vanguard ADA Systems helps with some answers; “No, they’re not part of the chirping crosswalks, they’re called detectable warnings and are literally ‘Braille for your feet’, for blind and visually impaired persons”. It seems that the ADA back some years ago, through various studies and acceptance of some results from other countries having some success with myriad edge protection from hazardous vehicular ways found that among all known surface textures detectable underfoot, detectable warnings (truncated domes), about as wide as a quarter and twice as tall, spaced in accord with new federal guidelines, gave blind and visually impaired persons a detectable surface that was distinctly unique from all other textures, giving them the same confidence in maneuvering around in the public areas such as sidewalks and crossing areas, as STOP signs and red lights do for people with sight.

Julnes goes on; “For several years the feds did an excellent job debating the correct size, shape and texture of these warnings, and by 2001 everyone had come to a consensus on the what, where and how issue. Because of this, prior to 2001, blind persons didn’t have a STOP sign like sighted people do and by virtue they weren’t privy to the same protection mechanisms that others take for granted every day. That meant many didn’t feel safe, or even mildly comfortable going for a leisurely walk even in their own neighborhood, buying an ice cream cone, going to the park to hear others laughing, or just walking around in a thunderstorm to feel something as simple as the pelt of raindrops on their face. Sighted people take all these things for granted. As a society, we can’t yet give them back their sight, but for very little cost, we can literally change the world for a group that’s growing larger every day”.

What about the cost? This is just another expense that we all have to bear isn’t it? Mr. Julnes continues; “What’s the price we’re collectively willing to pay to give someone not born with the same ability as the majority of the populace the capacity to maneuver safely, or a mentally challenged child who we’ll never be able to anticipate every possible outcome of the simplest decision to cross a street safely because it would just overwhelm them, yet now we can tell this same person ‘when you come to an intersection, look for the colored ramp…that’s a safe area to wait for cars to pass by’. For those people it’s a bargain, and it’s now a federal mandate.”

Naturally the argument runs into the obvious; why do blind people need a bright yellow ramp, that’s a little counterintuitive isn’t it?

“At first glance it does seem odd, but keep in mind” says Julnes “these laws were designed to provide protection for blind and visually impaired, those with limited sight as well as no sight at all. Consider that the bulk of accidents between pedestrians and drivers aren’t because the pedestrian made a judgment error either in timing or in fact, but rather, because the driver was on their phone, thinking of a meeting this morning, picking up the kids, or any number of things that we all go through every day and just plain didn’t see the pedestrian. That’s when trouble starts. Anything we can do to make these pedestrian areas and by virtue the pedestrians, blind or otherwise, more visible to everyone, makes the world safer for all”.

We can all live with that.

San Diego Building Crunch Calls for Soundproofing

San Diego boasts one of the best climates in the country, with an average daily temperature of 70.5 F, lots of sunshine and very little rain. Close by are many attractions including Lego Land, Knott’s Berry Farm, and the San Diego Zoo, but if you’re planning to live there, think again. San Diego has a critical housing shortage; only 10% of the land is currently available for urban use while 76% is designated for parks and recreation, or undeveloped.

Building Crunch Calls for Creativity:

San Diego boasts one of the best climates in the country, with an average daily temperature of 70.5 F, lots of sunshine and very little rain. Close by are many attractions including Lego Land, Knott’s Berry Farm, and the San Diego Zoo, but if you’re planning to live there, think again. San Diego has a critical housing shortage; only 10% of the land is currently available for urban use while 76% is designated for parks and recreation, or undeveloped.

In the first quarter of 2005, the average price for a new attached home was $422,220 and for a new detached home, $797,041! Because little space is available for building new homes and the cost of a new home is jumping upward each month, contractors and landlords have become creative.

Converting apartments to condos has become big business in San Diego, with about 3500 units converted or near completion since 2004. Because the average cost for these converted units is less than that for new housing, purchasing an apartment/condo conversion has become the best option for many first-time home buyers.
In California, converting apartments to condos is usually simple because the building code is the same for both. The California Civil Code Section 1134 requires the converting company to inspect each unit and disclose all defects or malfunctions in the “major systems” such as roof, walls, floors, heating, air conditioning, plumbing, and electrical systems. However, if contractors do anything structural, they may be liable for construction defect litigation so many simply modernize the units with new appliances, carpeting, and paint. In older buildings, this liability is a complex issue involving defects unseen within the structure (old plumbing for example), and the need for replacement vs. repair.

Imagine buying a condo only to find that you hear your neighbor’s every move, and that they can hear you! Old apartments converted and new condos being built may be lacking true comprehensive sound blocking construction. Insulating a wall blocks heat, but soundproofing a wall blocks noise The demand for condos is so great in the San Diego area and elsewhere that for some new units, deposits are paid and contracts written up to two years before construction actually begins! For home and condo owners-to-be, the time to plan with the contractor for soundproofing that will give true quiet and privacy is prior to construction. Although this is the easiest way to soundproof a unit, there are also many retrofit options available.

Plan Today for Quiet and Privacy Tomorrow:

Soundproofing your home during construction adds value, and your peace and privacy are guaranteed. Every contractor will tell you that planning on paper is much easier than changing wood and concrete. When meeting with your architect, builder, or contractor, think about possible sources of noise and include soundproofing in the construction plans.
-Does the house or condo face a high-traffic street? If so, soundproofing the exterior walls will block the noise from entering the interior of the home. Insulation house-wrap products are available that insulate and also deaden street noise. Tightly fitting double paned windows are also a must.
-If planning a condo, are you on the ground floor or will there be a unit below? If so, flooring underlayment will minimize the noise of footfall traveling through to the spaces below.
-If your condo shares walls (party walls) with other units, install soundproofing to block noise from the neighboring units.
-Will there be units above yours? The sound of footsteps, heard through the ceiling, can be reduced with a floor underlayment installed in the floor above.
-Prevent the sound of fluids flowing through pipes from being heard through the wall. Using a combination foam and acoustic vinyl barrier pipe wrap will minimize this noise.
-If a home theater is included in your plans, consider soundproofing the walls that adjoin other living areas to keep inside sound in and outside sound out. An acoustic vinyl barrier composite in the walls is excellent for this purpose.

Dallas Contracting Co., Inc. Begins Demolition of Former Rubber Plant To Make Way for Residential, Retail Project

Dallas Contracting Co., Inc., a specialized contractor providing demolition, dismantlement, onsite concrete crushing, equipment salvage and scrap metal recycling to various industries commenced the demolition of the former rubber plant / PQ detergent plant in Butler, New Jersey.

Avoid NPDES Fines

International Erosion Control Association Provides Tips to Help Builders Avoid Fines

(PRWEB) July 1, 2021 -- The International Erosion Control Association (IECA) has released a list of the top ten ways to avoid National Pollutant Discharge Elimination System (NPDES) Phase II fines.


The NPDES permit program controls water pollution by regulating point sources that discharge pollutants into waters of the United States. Builders can be fined if they do not comply with NPDES regulations.

According to IECA, the top 10 ways to avoid NPDES Phase II fines are:
1.Submit a Notice of Intent before starting work.
2.Obtain an NPDES permit before starting work.
3.Prepare a Storm Water Pollution Prevention Plan (SWPPP) before starting work.
4.Keep a signed copy of your SWPPP on site and update it regularly.
5.Implement all parts of your SWPPP throughout the project.
6.Properly train all involved contractors.
7.Correctly install and maintain Best Management Practices.
8.Perform timely inspections and correct problems within 48 hours.
9.Maintain complete records of all SWPPP activities.
10.Never discharge muddy water or other pollutants from the site.

The Title 24 California energy requirements went into effect in 1978 to decrease California's energy consumption.
