New York City Council Member Bill deBlasio: NYC Department of Buildings Must Reprioritize, Make Safety Number One Job

"While New York City's economy suffers, the DOB is going after an industry that supports thousands of local jobs and provides critical revenue to building owners throughout the city. The DOB over zealously targets outdoor advertisers and grossly over-penalizes them for non-harmful violations, while serving comparatively smaller fines for numerous potentially life-threatening violations at construction sites, including many related to crane operation," said deBlasio.
Councilmember de Blasio called for the DOB to 1) revise its penalty schedule so that it does not inflict unreasonable harm on the advertising industry while going lighter on safety issues; 2) end the practice of issuing what he feels are excessive violations; and 3) come to the table to work collaboratively with the industry and those who rely on it to reform billboard regulations.
"Given the danger inherently involved in the construction and maintenance of buildings, ensuring New Yorkers' safety must be the DOB's top priority. We saw last year just how grave the consequences can be when these regulations do not receive adequate enforcement. I intend to work with the Department of Buildings, my colleagues in the City Council and the industry to develop clear, consistent policies that enhance the protection of our City's residents from construction related safety hazards without strangling the outdoor advertising industry," said deBlasio.
Recent analyses illustrate that all but one of the penalties issued for crane and derrick violations are far lower than penalties for outdoor advertising violations. For example, exceeding the zoning size limit for a billboard nets a fine of $10,000. By contrast, operating a crane without a certificate of onsite inspection - an obvious safety issue - only costs violators $2,400. The large discrepancy between these two fines and others illustrates the need for the DOB to reassess its priorities. In addition, industry representatives estimate that the sheer number of violations received have increased over the past two years by a range of 400 - 1,000%.
"New York is the advertising capitol of the world, and billboards are as important to the city's character and economy as yellow cabs, Broadway shows, and parades," said Ari Noe, CEO of OTR Media. "But when it comes to imposing fines, the Buildings Department has put a target on our backs, and is threatening jobs in the process. We have tried repeatedly to meet with the Buildings Department to facilitate a rational process that makes sense for the city yet doesn't cripple the industry - unfortunately to no avail. We appreciate the effort now being made by Councilmember de Blasio and other members of the Council to bring sanity to this situation."
"Billboards are an essential and cost-effective means of marketing for local small businesses. And just as importantly, they are a necessary revenue stream for landlords during these tough times in the real estate market," said landlord David Sitt, vice president of Sitt Asset Management LLC. "All we're asking is that the Buildings Department regulations be fair and reasonable."
Local law 14 of 2001 set the maximum penalty for outdoor advertising violations at $15,000. Industry representatives report, however, that the DOB often issues as many as eight different violations for each sign, totaling anywhere from $80,000 - $120,000 per sign.

Demolition Doesn't Mean Destruction - 1870's Railroad Shop Gets new Life
Pioneer Millworks recently salvaged 50,000 board feet of antique heart pine and white pine timbers from the old Delaware & Hudson Rail Car Maintenance Shop in Oneonta, NY -- part of the railroad yard that was once home to the world's largest roundhouse.

"When you stop and think about the history of this wood, you begin to see why it's so prized: these timbers were cut in the late 1800's from trees that probably started to grow in the 1600s. Now, after 140 years supporting this historical railroad structure, these Heart Pine and White Pine timbers will begin a new life as eco-friendly flooring, paneling, and millwork for residential and commercial structures," says Jered Slusser, wood expert at Pioneer Millworks (and Delaware & Hudson train geek).
Pioneer Millworks is renowned for reclaiming antique wood from old industrial buildings like the Delaware & Hudson shops. The timber used to build these structures in the 1800s are no longer available (such as Heart Pine and Chestnut) because the forests are now gone. Tighter growth rings, greater stability and deeper patinas are just a few advantages of these old growth species. Pioneer Millworks painstakingly recovered the antique timbers in an effort to keep a piece of history from being buried in a landfill or burned. Once at the mill, the timbers will be scanned for nails and other metal artifacts, then planed into planks for tongue and groove flooring (solid or engineered), ceilings or other hand crafted millwork.
The Delaware & Hudson railroad was one of the oldest transportation companies in the country. It began in 1828 as a canal company operating from Honesdale, PA to Kingston, NY. After constructing its first railroad line in 1868, the D & H became known as "The Bridge Line", linking central Pennsylvania with Canada. As the railroad grew, so did the need for centralized maintenance facilities. Thus in the 1870s, the company built the roundhouse and shops in Oneonta. The Delaware & Hudson Roundhouse was known to be the largest in the world. Centralized maintenance facilities like the shops that supported it kept D&H railroad cars running smoothly through the mid 1990's. Today, the railroad is owned by Canadian Pacific and has since closed down large facilities like this, opting instead for new, consolidated shops in major cities.

Objectivity, Inc. Posts Double-Digit Growth for First Half of FY09
Database management company realized record revenues in second quarter
Sunnyvale, Calif. USA Insulation Customers Eligible for Federal Energy Tax Credits as of January 1st
Energy-efficient tax credits for home improvements have been extended to cover home insulation throughout 2009.
Cleveland, OH (PRWEB) January 6, 2009 -- Homeowners who choose to add insulation during 2009 will be eligible for a federal tax credit of 10 percent of the cost, up to $500. The Emergency Economic Stabilization Act of 2008 outlined a number of tax incentives for government, businesses and utilities, and extended or amended multiple consumer tax incentives that were originally introduced in EPACT; the Energy Policy Act of 2005.
The Emergency Economic Stabilization Act of 2008, Energy Improvement and Extension Act of 2008 (H.R. 1424), and Tax Extenders and Alternative Minimum Tax Relief Act of 2008 gives the Secretary of the U.S. Treasury the authority to extend expiring tax provisions and establish energy tax credits.
In the United States tax system, a tax credit is recognition of a partial payment made toward total taxes owed to the federal government. Tax credits are considered more valuable than a tax deduction because a credit will reduce taxes, dollar-for-dollar, whereas a deduction only reduces a percentage of taxes owed.
Home improvement energy tax credits are available to consumers who purchase and install certain products that include insulation, doors, roofing, heating and cooling equipment as well as energy efficient windows. The energy tax credit is applicable to home improvements that are 'placed in service' between January 1st, 2009 and December 31st, 2009. Home improvements that were purchased and installed in 2008 do not apply.
In the typical American household, heating and cooling are responsible for 50 to 70 percent of the energy used. The number one cause of wasted energy in the home is inadequate insulation. According to the United States Department of Energy, Office of Building Technology, adding proper home insulation is the most effective method for reducing utility bills.

Green Building Consultant's Top Ten Predicts Green Building Growth Despite Economy
Projections by green building consultant Jerry Yudelson say that the green building industry will grow substantially in 2009 despite the global economic recession.
Tucson, Arizona (PRWEB) January 6, 2009 -- Green building consultant Jerry Yudelson has published his "Top Ten" list of green building trends for 2009. Yudelson says that green building will continue to grow in spite of the global credit crisis and the ongoing economic recession in most countries
"What we're seeing is that more people are going green each year, and there is nothing on the horizon that will stop this trend," explains green building consultant Jerry Yudelson, the principal of Tucson-based Yudelson Associates. "In putting together my Top Ten trends for 2009, I'm taking advantage of conversations I've had with green building leaders in the U.S., Canada, Europe and the Middle East over the past year."
Yudelson's Top Ten trends includes the following:
1. The green building industry will continue to grow more than 60 percent in 2009, on a cumulative basis. "We've seen cumulative growth in new LEED projects over 60 percent per year since 2006, in fact 80 percent in 2008, and there's no sign that the green wave has crested," he said.
2. Green building will benefit from the new Obama presidency, with a strong focus on green jobs in energy efficiency, new green technologies and renewable energy. This trend will last for at least the next four years.
3. The focus of green building will begin to switch from new buildings to greening existing buildings. "The fastest growing LEED rating system in 2008 was the LEED for Existing Buildings program, and I expect this trend to continue in 2009," said Yudelson.
4. Awareness of the coming global crisis in fresh water supply will increase, leading building designers and managers to take further steps to reduce water consumption in buildings with more conserving fixtures, rainwater recovery systems and innovative new water technologies.
5. LEED Platinum-rated projects will become more commonplace as building owners, designers and construction teams learn how to design for higher levels of LEED achievement on conventional budgets.
6. Solar power use in buildings will accelerate with the extension of solar energy tax credits for buildings through 2016 and the prospect of increasing utility focus on renewable power goals for 2015 and 2020. As before, third-party financing partnerships will continue to grow and provide capital for large rooftop systems.
7. Local governments will increasingly mandate green buildings from both themselves and the private sector. While concern over economic impacts of green buildings mandates will be present, the desire to reduce carbon emission by going green will lead more government agencies to require green buildings.
8. Zero net energy designs for new buildings will gain increasing acceptance in both public and private buildings. "I've shown that you can get building energy use down to low levels with better design," said Yudelson, "and that makes it easier and more cost-effective to buy green power to displace the remaining energy use."
9. Green homes will come to dominate new home developments in more sections of the U.S., as builders increasingly see green as a source of competitive advantage. "This trend was foreseen in my 2008 book, Choosing Green (New Society Publishers), which for the first time documented the large number of new green housing developments in the U.S. and Canada."
10. European green building technologies will become better known and more widely adopted in the U.S. and Canada. "My forthcoming 2009 book, Green Building Trends: Europe (Island Press), will be out in the spring and will help accelerate this trend, along with more European architects and engineers opening offices in the U.S."

Capmark Finance Inc. (Capmark Finance) originated $3,900,000 in fixed-rate financing through its Freddie Mac program for the acquisition of Dominion Apartments, a recently constructed multifamily property in Ocean Springs, Miss.
