Diane Fleming Petition for Habeas Corpus; Judge's Decision for Evidentiary Hearing Could Take Six Months

The motion hearing for an evidentiary hearing is the first step to freedom after the incarcerated petitioner's state appellate and supreme court appeal has been rejected.
Diane Fleming’s motion hearing to grant an evidentiary hearing was held on Friday, January 6, 2006. Eleven supporters came out to support Diane even though she was not in the courtroom. Inmates are not allowed to attend their motion hearing. The hearing started late in Judge Cleo E. Powell’s Chesterfield, Virginia courtroom.
Diane Fleming's attorney, David Hargett, of Richmond, Virginia, specializes in ‘habeas’ law. Mr. Hargett told Diane’s supporters that most judges are not familiar with habeas law because most cases don't get this far. Before a motion hearing is granted, the Commonwealth of Virginia’s Attorney General office is involved and must give a go-ahead.
Contrary to expectations, although the motion hearing has been approved and granted by the Attorney General’s office, at the motion hearing, the Attorney General’s office rebuts the very points it had to concede to approve and grant the hearing.
Here’s why. When a petition for a writ of habeas corpus is filed, the case almost becomes a civil suit. Diane Fleming v. Warden of the Fluvanna Correctional Center for Women. Guess who represents the Department of Corrections? The Commonwealth of Virginia’s Attorney General.
Hargett led Judge Cleo Powell through all 22 citations in Diane’s petition for a writ of habeas corpus. Although Judge Powell remained impassive and asked only a few questions, Hargett knew Judge Powell had read the habeas. Powell was also the trial judge, in 2002.
Included in the 22 counts of ‘deficient’ counsel and prosecutorial misconduct is the withholding of tests from the Virginia Forensic lab (to the defense) that there was no blue color found in the Gatorade. Diane was convicted to 30 years for murder and 20 for adulteration, to be served concurrently, for supposedly spiking her husband’s Gatorade with windshield washer fluid, containing methanol, wood alcohol, a poison.
In response to the accusation, Denise Anderson, the lawyer from the Attorney General’s office stumbled as she told the court that the test results couldn’t have been withheld because: ”They (the tests) were not done or were not done correctly.”
Hargett explained to Judge Powell that there was no clear cause of death in the autopsy. Cardiomegaly, enlarged heart, shown in Fleming’s autopsy, is a cause of death, in itself.
Hargett told Judge Powell that there is a test that can tell exactly where the methanol in the Gatorade originated. The NFT1 gas chromophotography test can solve the mystery of how methanol got into the bottles of Gatorade, still in evidence.
Another test called the Raman Microscope test can further determine the identity of the source of methanol in the Gatorade.
Ms. Anderson, the attorney from the Virginia Attorney General’s office reportedly is new at the job, no match for the veteran Hargett who was professionally attired in a charcoal grey suit, white shirt, and blue striped tie.
At one point in the hearing, Hargett emphatically brought his hand down on the table and addressed Anderson, the court and Diane’s supporters. “The state’s ‘computer expert’ who testified at trial was not qualified as an expert.”
A date from one of the computers in the Fleming home showed a methanol search by Diane one month before Charles became ill after playing basketball on a hot June Sunday, in 2000. An expert would have known to check with the web site supposedly searched to corroborate the alleged date.
The brutal fact is that the court was not allowed to hear the most probable cause for Charles Fleming’s death. According to Virginia law, no new evidence can be brought up in a habeas writ or at a motion hearing; evidence must have been presented at trial.
As a researcher for nine years concerning aspartame (Equal, NutraSweet) poisoning, it is my opinion that Charles Fleming’s autopsy shows that he died from the cumulative methanol in aspartame (10% of the molecule) from drinking 10 diet Cokes a day and 2 diet-Sprites, plus the addition of packets of Equal to every thing he drank.
On the FDA list of symptoms from aspartame, released in 1993, under the Freedom of Information Act, Death is No. 77. Fleming also suffered from other neurotoxic symptoms on the FDA list.
Toxicologist Dr. Hildegard Staninger concurs that aspartame was the cause of death as does Dr. H.J. Roberts, M.D. (“Aspartame Disease: An Ignored Epidemic”) in affidavits written to help free Diane.
Many of Diane’s supporters are anxious about the outcome of the hearing. Judge Cleo E. Powell has the power to deny or grant Diane Fleming an evidentiary hearing, the second step in her road to freedom.
If the evidentiary hearing is granted it means, according to David Hargett’s legal assistant, Mary Beth Rider, “We’ll be able to gather evidence that will help prove Diane’s innocence. It does not mean Diane Fleming will be released from prison or granted a new trial.”
Judge Powell’s decision to grant Diane Fleming an evidentiary hearing could take six months.

Paper Industry Pilot Coater Optimized with Ronningen-Petter DCF Self-Cleaning Filtration System--A Real World Documented Case Study
Two Ronningen-Petter Disc Cleaning Filter (DCF) stations help contract paper-coating R&D line increase capabilities, flexibility, and ease maintenance.
(PRWEB) January 12, 2006 -- SITUATION: When a new contract paper-coating pilot plant opened recently, it sought to enhance operational capability, flexibility, and maintenance to better approximate production runs for paper mills and converters who were looking to improved their current products, develop new products, or try new coating methods/equipment.
The coating plant (along with its sister plants) is a strategic R&D resource for the paper and printing industries. Ninety percent of the plants activities -- including coating, papermaking, printing, and recycling -- support their operating budget through contract services within the paper and printing industries.
Because of the variety of coatings and papers involved, proper process filtering of the type found in the actual paper mills was a critical part of enhancing the coating plant's operational capability, flexibility, and maintenance. This would better approximate production runs for paper mills and paper suppliers, and would result in more efficient production and better margins for them.
The coating plant turned to Ronningen-Petter (RPA Process Technologies) for an effective process filtration solution.
After the engineers at RPA reviewed the filtration process, they notice that the coating plant had different flow rate needs depending on the setup configuration of the coater.
Taking into consideration that sometimes one coating would be used, and other times two different coatings would be used, the pilot plant ended up with an automatic filtering system that is used in mill metering size press installations and applications where similar setup needs exist.
SOLUTION:
Two Ronningen-Petter Disc Cleaning Filter (DCF) stations now share the same drain lines and inlet-outlet headers at the coating pilot plant, and are located between the run tanks and the coater.
The beauty of this type of set-up is that if the company needs to use one DCF station for one coating -- and the second station for another -- they close the two butterfly valves installed in the headers that separate the stations.
They can then open these valves when they need both stations for single high-flow rate applications. This allows the filter to act like two filters, and saves the expense of two control systems and piping.
HOW IT WORKS:
With the DCF self-cleaning filter, coatings enter the top inlet of the filter housing and passes through the screen. The screen holds any particles over 75 microns, while cleaning coating exits the bottom outlet of the filter.
A cleaning disc moves up and down the filter screen, removing debris. With the aid of the downward fluid flow and the disc movement, the debris is deposited into a holding chamber at the bottom of the filter housing, and it regularly purged from the housing via a valve at the bottom of the chamber.
RESULTS:
The coating company monitors the DCF filter's differential pressure to see if the cleaning system is being over tasked by a high debris level in the coating.
The good news is that they have not found a coating or dirty base stock it could not handle.
The differential pressure remains steady. Its ability to remove air from a coating is also a great asset for run ability, especially when we are operating the short dwell applicators.
The best part is that the filter is very easy to clean, and they have not found it necessary to open it to remove coating. They simply flush the system with water and have no compatibility problems. This is yet another example where a Ronningen-Petter filter has exceeded our customer's expectations!

Burkhalter Engineers Biggest Freight Transfer at Kentucky Port
Successful barge offload and heavy haul delivery of JIER mechanical presses to DANA Corporation by Burkhalter Rigging adds significant economic potential to the Eddyville River and Industrial Port Authority.

Burkhalter Rigging will deliver four presses in all — two that weigh 2,500 tons each, and two that weigh 1,000 tons each. Burkhalter Rigging was chosen by Toledo Press Company to transport and millwright the four metal-stamping presses manufactured by the JIER Mechanical Press Company. The stamping-press components were offloaded from a barge by a self-propelled Goldhofer trailer. Transportation overland was by a Goldhofer, 16-line, 1 1/2 wide, multi-axle hydraulic platform/trailer.

Chemigation and Fertigation Systems Improve Golf Courses while Staying on Budget
Diaphragm-design, chemical metering pumps provide greater accuracy to save fertilizer and water, while reducing maintenance.
(PRWEB) January 5, 2006 -- If the saying that "your greens are your resume" rings true, then competition among course superintendents is just as fierce as that of a Ryder Cup Match. Hardly a game though, the health and appearance of the entire landscape of a golf course can make or break the financial existence of the course itself. Faced with mounting utility, labor and fertilizer costs, an increasing number of managers and superintendents are introducing necessary turf-maintenance fluids via modern chemigation and fertigation systems that help slash operating expenses through increased accuracy and decreased maintenance.
"Irrigation fertigation can definitely save some hard dollars for golf courses," says Gary Hammerlund of L.L. Johnson Distributing Co., a Denver, Colorado-based wholesale distributor of Toro outdoor power equipment and turf and irrigation supplies for turf care and maintenance applications throughout the Plains. "Liquid metering pumps are less expensive than the piece of mobile equipment it takes to put down granular fertilizer, plus you save on man-hours because no one has to manually apply the fertilizer."
The concept of using existing irrigation systems to simultaneously apply fertilizer and other fluids while watering was developed by Gary Newton, who subsequently founded Agri-Inject, Inc. in 1983. From its base in Yuma, Colorado, the company has continued to be an innovator of chemigation fluid application technology.
To realize the maximum benefits that chemigation and irrigation fertigation has to offer, golf course superintendents increasingly select their equipment with the same care as pros select their clubs for the next shot. As James Francis Moore -- director of the USGA Green Section's Construction Education Program at the time -- wrote in the Green Section Record March/April 1998: Component quality...should be nothing less than first-rate.
"I've researched a lot of pumps and could have gone in many directions, but I've stayed with the Agri-Inject fertigation systems," says Hammerlund. Agri-Inject's chemigation systems utilize Milton Roy chemical metering pumps that employ Teflon diaphragms that flex gently to provide accuracy within +/- 1% to eliminate both over and under-fertilization, as opposed to inaccurate piston-type pumps employed in earlier-generation systems that can waste as much as 5% of chemical volumes.
Since the diaphragm-design separates the internal workings of chemical metering pumps from the fluid being sprayed, it prevents leaks common to piston-type pumps. Keeping the fluid away from moving metal parts also helps prevent corrosion and makes it possible to spray thick substances like gypsum and soil polymers without clogging the chemigation pump. Combined with oil-bath lubrication of moving parts, maintenance is reduced and pump longevity increased to the point that Agri-Inject can offer a five-year warranty on its Milton Roy Series metering pumps.
"When an average golf course budget is $35,000 per year for chemicals and fertilizer, every edge helps," notes Hammerlund. "The golf and sports turf industry is starting to realize the advantages of liquid irrigation fertigation versus granular applications.

51-day Return-on-Investment for Hydroforming Plant -- A Real World Documented Case Study
A supplier of pickup truck side-rail frames wanted to reduce their operating costs and increase profitability. They knew that their current process was not cost effective or environmentally friendly, mainly due to the need to dispose of their entire 1,100-gallon coolant system on a weekly basis. The cost associated with this waste was becoming enormous. In addition, the future impact to the environment due to the coolant/lubricant waste was unknown. This prompted the Production Manager to contact Ronningen-Petter due to an article he saw on the Internet. After a consultation of their complete process, they got more than they bargained for! They installed a Magnetically Coupled Filter (MCF) on their Hydroforming operation -- and in addition to a safer process for their workers and environment -- they got a 51-day return on investment!

SITUATION
The pickup truck frame manufacturer (the customer) was using press technology to convert a straight mild steel tube into a side-rail, otherwise known as Hydroforming.
As part of the process, coolant is pumped inside of the tube to counteract the forces of the presses to bend and shape the tube into the final product.
After each operation, the coolant goes to an accumulator pit along with oil and metal debris created by the Hydroforming.
This coolant is collected and then put through a series of filtration steps to remove the oil, and then the collected metallic particles from the process.
Periodically, the coolant is pumped out of the pit to a paper-band filter, where the larger metallic particles are removed.
After this first stage, the coolant goes to a series of cartridge filters to remove the smaller metallic particles. This is known as a staged-filtration process.
The customer had a number of challenges for the Ronningen-Petter MCF filter. First and foremost, the system had to be able to withstand the rigors of this 24/7 operation.
Initially, the customer sought to have the MCF -- with 25-micron slotted elements -- replace the cartridge filter. As with any disposable media filter, the cartridge costs were high, as well as the labor costs to change out the media.
In addition, there were the cost to refill the system with chemicals and water -- upwards of $500 each time -- and the disposal costs. All of which were eating in to the bottom line.
Most importantly, the oil and debris content of the coolant system were such that the customer had to dispose of their entire 1,100-gallon system on a weekly basis.
This meant downtime to the manufacturing process to enable them to pump out the system capacity, and subsequently refill the system with fresh coolant.
SOLUTION
The customer decided to install a single Ronningen-Petter MCF filter on the front-end of the process ahead of the first stage, or paper band filter.
Although the ultimate goal was to replace the cartridge filter, the customer wanted to see what influence the MCF might have on the entire system if it was installed at the beginning.
If that challenge was not enough, the customer installed the filter when the coolant system was at its dirtiest, and would normally need replacing.
Clearly, the customer was going to give the MCF a rigorous test.
RESULTS
To the customer's surprise, after eight-weeks of operation, they had not replaced a single cartridge filter.
In addition, the customer was able to disconnect the paper-band filter altogether because the coolant quality coming out of the MCF rendered the paper-band filter useless.
If that was not enough, according to the Production Manager the coolant in the system was “the cleanest we had ever seen." Moreover, they had "not needed to replace the coolant in the system during the entire time the MCF was installed."
This meant that over the eight-week operating time, the customer had saved approximately 8,800 gallons of coolant!
An added benefit -- in the customer's eyes -- was the amount of oil the MCF was removing.
The oil was agglomerating to the metallic debris in the coolant, and when the debris was removed from the screen, and ultimately purged from the filter, the oil was purged along with it. As a result, the buildup of oils in the coolant was reduced significantly.
Due to this very successful installation, the customer realized measurable savings on:
The reduced usage of cartridge filter elements.
The elimination of the labor to change out the cartridges.
The reduced disposal costs for the cartridges.
The extended life of the coolant system ( 8 weeks + vs. 1 week ).
Machine uptime as a result of the extended coolant life.
This truly was a case where the performance of a Ronningen-Petter MCF industrial filter exceeded our customer's expectations!

Voltaix Extends SiGe Leadership with Support from National Science Foundation
